SELECTION PROCESS ACCORDING TO LGPD

For the purposes of transparency and maintenance of the Data Protection Legislation, the LGPD, for TATICCA's selection and hiring process involves a series of processing of the interested candidate's personal data. Precisely for this reason, the selection must be made in compliance with the LGPD.

It should be clarified that the recommendations set out here are applicable both if the employee is hired, as well as in the event that the candidate is not hired.

In this case, the processing of personal data occurs in the selection process, so the consent of the data subject will be the legal basis for this to occur, the candidate must be made aware of the requirements to apply for the vacancy, that his data will be collected, emphasizing that freely.

So that the consent of the holder of personal data, in its free, informed and unequivocal expression in which it agrees with the processing of personal data, for the specific purpose of participating in the selection process.

When recruiting employees, through specialized websites that contain CV banks, it is understood that the professional registers their CV or profile on this type of website for a specific purpose and that their CV is accessed and considered for filling professional vacancies. Therefore, he consents to the use of the information deposited there, provided that the use is restricted to the aforementioned purpose. Thus, if this purpose is respected, CVs collected on specialized sites can be used.

In the LGPD system, the figure of solidarity is present in the liability for damages resulting from the illegal use of personal data (Art. 42, I and II, LGPD). In this situation, specifically, The legal basis will be the candidate's consent to process personal data in order to participate in the recruitment and selection process. (Article 7, item I of the LGPD).

The data will be processed during the period in which TATICCA is conducting the recruitment and selection process and stored until consent is withdrawn by the data subject or at the end of the process, as the period for maintenance and storage of data with legal basis, it is recommended that at the end of the selection processes, the data should be deleted.

These data will be treated under the terms set out in the rules in force, regarding the protection of personal data, therefore, the purpose of use follows:

  • Right to file a complaint with the Legal Control Authority (ANPD) if you consider that the treatment does not comply with the regulations in force.
